Cocaine Possession Defense Lawyers
Any criminal allegation involving cocaine has the potential to create major problems in your life. The penalties associated with the possession, delivery or manufacture of cocaine are all very serious. If you or a loved one faces any of these charges, you need a lawyer on your side who will protect your rights and seek a favorable resolution to this difficult situation.
At Raivio, Kohlmetz & Steen, our lawyers are devoted to helping people facing serious criminal charges. Our four lawyers offer more than 70 years of combined experience in criminal defense and will put forth an aggressive defense to these potentially life-changing charges.
Unlike federal law, Oregon law does not differentiate between crack cocaine and cocaine in powder form. Cocaine possession is a Class C felony. Cocaine delivery is a Class B felony. If you are found to have delivered cocaine to someone under the age of 18 or within 1,000 feet of a school, it is a Class A felony. The manufacture of cocaine is a Class B felony, unless you were found to have manufactured cocaine within 1,000 feet of a school. In that case, it is charged as a Class A felony. Unlawful delivery of cocaine to a minor can carry a 34 to 72 month mandatory minimum prison sentence. Unlawful manufacture or delivery of substantial quantities of cocaine can carry a mandatory minimum sentence of 34 to 130 months in prison.
If you are accused of delivering an illicit drug to someone who later dies of an overdose, you could be liable on federal charges.
In every case, our law firm will attack the validity of the evidence against you. In too many cases, overzealous law enforcement agents violate defendant's Constitutional rights when gathering evidence. If the evidence in your case was obtained illegally, we will ask the court to suppress the evidence. Our attorneys will find any weaknesses in the state's case and exploit these weaknesses. Our skilled, strategic approach has led to dismissals, acquittals and reduced charges on many occasions.
